Question about copywrite/MAME

Just out of curiosity, does anyone know under what criteria MAME decrees a game available for the project? Is it just when the PCB is no longer available from the creators or what? MAME states that it is when the game is no longer for sale so no profit is lost, but some of the games are still being sold on other platforms (Playstation etc)?
