I'm not sure on all the laws but maybe the complaints are with the use of ROMS, which are the major copyrighted creative artworks that are being stolen etc...I'm not sure how the legalities work with just emulating processors themselves...I think it would be illegal to directly steal a processor's chip layout and build your own duplicate of it, direct theft, or even some degree of hardware reverse engineering, but to write your own software that simply reads in the code instructions from a ROM (program) and just translates it into something that another processor can make use of..it's a language translator...and doesn't necessarily do anything illegal..I think.

Just like illegal TV descramblers...I forget what I read on that, but overall I don't think it's illegal to build a device that can manipulate television signals and ultimately descramble them, but it IS illegal to use that device to steal the signals, which is its useage...so the end rumour is "descramblers are illegal" but it's really the act of video piracy that's wrong.
